Noon flexible cancellation terms

Do they apply to you:


These Terms apply to a Booking if you paid a Flexible Cancellation fee to Sykes Cottages Ltd (Sykes) when you made it (Relevant Booking). They do not apply to bookings of Forest Holidays properties.

 
Booking:
 

Is as defined in the UK Booking Terms and Conditions at https://www.sykescottages.co.uk/terms/booking that you agreed to when making it (Booking Conditions).

 
Definitions:
 

Defined terms used in these Terms, shall be as defined in the Booking Conditions or within these Terms.


Flexible cancellation:


    1.    Subject to 2. and 3. below, if you choose to cancel a Relevant Booking before noon (being 12pm) on the day it is due to start (the Last Time to Cancel), you will get what you paid back excluding any insurance premiums and the Flexible Cancellation fee (Returned Amount).

    2.    The maximum Returned Amount for any Relevant Booking is £10,000, even if you paid more than this

    3.    You are not entitled to any Returned Amount for a Relevant Booking under these Terms if one or more of the below applies to you:

    a.    you provided incorrect information, or information that is considered fraudulent, when you made it;
    b.    you did not cancel the Relevant Booking, Sykes or a property owner (Owner) did;
    c.    you did not cancel the Relevant Booking before the Last Time to Cancel;
    d.    you were in breach of the Booking Conditions and/or Low Deposit terms and conditions at https://www.sykescottages.co.uk/terms/lowdeposit (Low Deposit  Conditions) when you cancelled the Relevant Booking;   

    e.   you had the right to cancel the Relevant Booking under the Booking Conditions, before you did so, because of Sykes or an Owner’s actions that affect the Relevant Booking, the property (Property) and/or the amenities at the Property, in all instances as advertised at the time you made the Relevant Booking;
    f.    the cancellation was because of a weather event that affects the Property and meant the Owner could not satisfy its obligations to you under the Booking Conditions;
    g.    the cancellation was caused by a restriction to travel as advised or legislated by any Government or local Government authority arising from any epidemic or pandemic as declared by the World Health Organisation.


    4.    If you are not entitled to any Returned Amount for a Relevant Booking under these Terms, you may, or may not, be entitled to an amount that you paid for your Booking back under the Booking Conditions or an agreement you have with a third party (for example an insurer for travel insurance). Please remember to consider this too.

    5.    The Returned Amount will be paid to you by Sykes. Sykes does this by (a) refunding the amounts you paid to it (e.g., Booking Fee, low deposit fee, change of date fee and Sykes Other Services Charges) and (b) paying you an amount equal to what you’ve paid to the owner of the property you booked (e.g., the Rental Charges (including extras).

    6.    Where you are not entitled to a Returned Amount for a Relevant Booking, the Booking Conditions and Low Deposit Conditions apply in respect of that Relevant Booking. You shall not be able to recover an amount under these Terms and the same amount under the Booking Conditions (i.e. the Terms do not allow for double recovery of the same amount).

    7. Clause 20.6, 20.7 and 20.8 shall apply equally to these Terms.
